All things considered, Real Networks got off easy by settling with the studios in the RealDVD case for $4.5 million in legal fees. Whatever claims Real may have had under the fair use doctrine, the studios had it dead to rights on their DMCA claims. Real also faced a clearly unsympathetic judge. Had the case gone to trial, Real would almost certainly have lost and the damages would have been far higher. Alas for consumers, we still don’t have a definitive ruling on whether copying your own DVDs is or should be legal.
